Group One-winning jockey Jack Nicholls has been suspended for 25 days, eight of which have been deferred, after breaching the whip rules five times in six months.
At the time of the John Mackenzie and Hamish MacGregor Memorial Handicap at Hamilton, Nicholls was still claiming 3lb when his mount, Strength Of Spirit, was beaten a short head into second.
He was found to have used his whip seven times, once more than the allowed six, and it was the fourth time he has gone over the permitted level in the space of six months.
The eight days are deferred for a period of six months or 200 rides, whichever comes first, and one is to be spent receiving specialised coaching.
In the published result Sam Magee KC, a judicial panel member, brought up that Nicholls had committed five breaches in 155 rides between June 23 and September 28, resulting in one breach every 31 rides.
He said: “More troubling still, the BHA wrote to him on 14th August and again on 15th September warning that he was close to totting up. Within a fortnight of the second letter he had offended again.”
In Nicholls’ favour was that each breach was at the lower end of the scale and that this was his first referral.
Nicholls, son of trainer Adrian and grandson of former trainer Dandy Nicholls, won the Prix de l’Abbaye at ParisLongchamp on Karl Burke’s Miss Yechance last month.
He rode the same filly to finish 10th of 16 in the Breeders’ Cup Turf Sprint behind Bacio on Saturday.
